Stay of Rajasthan High Court on notificationm of declaration of results of Central Council

ANNOUNCEMENT REGARDING NOTIFICATION OF THE DECLARATION OF RESULTS OF ELECTION TO THE COUNCIL AND REGIONAL COUNCILS
6th January, 2010
The Notification of the declaration of results under Rule 36 of the Chartered Accountants (Election to the Council) Rules, 2006 was to be published in the Gazette of India dated 6th January, 2010. While the Notification on the declaration of results of election to the 20th Regional Councils is being notified in the Gazette of India dated 6th January, 2010, however, the notification on the declaration of results in respect of election to the 21st Council is withheld arising out of the Stay granted by the Honourable High Court of Judicature for Rajasthan, Jaipur Bench, Jaipur vide its Orders dated 5.1.2010 in Civil Writ Petitions Nos. 157/2010 and 158/2010.

Please wait for the further Announcement in respect of the Notification on declaration of the results of election to the 21st Council.

    Would certainly like to know the grounds on which the Hon. HC of Rajasthan has granted a stay on the declaration of results. Also would like to know names of the petitioners and the reasons for seeking a stay.

    The last decade gone has seen so many things; Rising of Indian Economy as most growing economy along with China. Indian market has been most sort markets by the rest of the world and many MNC’s have came to India.

    At personal level I would call the decade as the decade for telecommunication revolution. The world has also seen the financial crisis which most of the working professional would have just read in books but they were lucky enough to experience it.

    On the Our Professional front, the highlights of the decade would be the up surging of the Profession Chartered Accountancy, which has changed leaps and bounds. There have been many alliances with Professional Bodies of various Countries which has helped improving the value of Brand CA. The latest being the Excellence Award to ICAI from H.E Smt. Pratibha Patil, President of India.

    However, additionally the election process has more drastically. The elections processes have brought politics into the noble profession of Chartered Accountancy. The earlier philosophy of selection based on merits has now been replaced by popularity. The candidates seeking elections have been spending money left/right for publicity and gather Votes. I am not surprised to see the stay granted by Honorable High Court.

    In one of your Blogs you have written about who will Rule the WIRC for next three years, which in uncertain terms means the combination of 12 people who get together will run the show. I wonder how other members can be effective in that scenario.

    The election process needs to be reviewed and necessary changes should be brought.

    The decade ahead will see many more such things, but I am personally of the view that the coming decade would bring in revolution in Power Sector. There is still a huge amount of scarcity of power and whole lot of opportunity to bring in operational efficiency.

    The kind of vulgar election ptopaganda, candiadate directly being promoted by the vested intrests, the huge pots of moneys spent and gallons of alcohol poured in pre/post election paries, snd a booth capturing, past presidnts on Satyam Board - Ved Jain and Maoharan and present president going to fallow as seluth to interogation all indiacted that ICAI is no lomger a noble body but a playground for the mighty .I am not at alll surprised but I do fear that unworthy and the pygmies will be the bharat bhagyavidhata.
